The Delhi High Court has made a strong comment on the death of a woman and her son after falling into a drain in Ghazipur area of Delhi on July 31. The court told the MCD, “If you do not take action, we will start suspending your officers.”
The Delhi High Court, while hearing a PIL seeking compensation for the family of a woman and her son who died after falling into a drain, reprimanded the DDA and the MCD.
The court summoned the police and MCD officials to the court. In the case of two people dying after falling into a drain in Delhi, the Delhi High Court reprimanded the MCD official and said, what are you doing there? Have you even gone there? The MCD lawyer said that there are two different tenders. When the site was handed over to us in October, about Rs 20 crore was taken for road repair. The total length of the roads handed over was about 9 kilometers.
The order was for 1250 meters. It was for Rs 4 crore. The work is going on. The road is being leveled. Barricading is being done on it and it will be done in two days. The court said that 2 people have lost their lives here. The MCD lawyer said that this is not in the MCD area. Whereas the petitioner is questioning a different circular which is about a different drain. NGT had ordered that the storm water drain should not be covered.

The court asked why can’t you build a barricade? To this the MCD said that we will do the same now. Instead of covering it, we will put up railings. The court said that you should have done this work yourself earlier. God knows when you will do it. The garbage lying there is at least months old. The lawyer said that DDA had handed it over in this condition. They had kept it like this for such a long time. A part of the question should also be asked from DDA.
The court said that we don’t know how you are allowing this to happen in a city like Delhi. The standing committee is a perennial problem. You will have to solve it. On this, the MCD official said that a lot of garbage in the border area also comes from UP area. By June, one phase of cleaning was completed. The court said that if this is your level of cleaning, then this is a sad situation and you should not work. The problem is that you are not working. You do not work and none of your senior officers have the courage to take action against you. We do not know that there can be so much filth in a civilized society. After these pictures, do you think you should have said anything? You should have apologized. It seems that MCD is now out of our control.
The MCD lawyer argued that now we have a new commissioner. The court said that this is the only mitigating factor. The man should have apologized on the first day itself. Do you think his boss can control him? These people are beyond the stage of leniency. When the officer apologized, the court said let it be passed in the full house. Will anyone in the full house oppose barricading on the roads? We have commented earlier also on how things are working in the Delhi administration. There is no date for the standing committee or cabinet meeting.
The High Court reprimanded the Delhi Police and said that again they have not seized any file. Nothing has been done. They are not aware of the situation. Please ensure the files of MCD and DDA. The police lawyer said that the IO says that he has asked for the files. The court said ask them? You can apply under RTI. Are you a police force or what? The court told the Delhi Police to file a proper detailed status report with a translated copy of the FIR in 2 days. The court told the MCD and you will get the place cleared. If you cannot cover it then at least barricade the place. This is basic common sense.
A bench of Acting Chief Justice Manmohan and Justice Tushar Rao Gedela said that the DC of Shahdara South Zone is also present in person. He told the court that the concerned drain will be cleaned and the garbage will be removed immediately. The MCD was directed to file a fresh status report with photographs within a week. The matter will be listed after 10 days. We cannot decide who is responsible, DDA or MCD. This has to be done by the police.
