Understand the political meaning of the Nazul Land Bill which died an untimely death in the Legislative Council in these 5 points

It is no longer a secret that everything is not going well in Uttar Pradesh BJP. But at the beginning of this week, it seemed that everything had been sorted out with the intervention of the Centre. But the more the medicine is given for the disease, the more it is increasing. The matter got so complicated that the Nazul Land Bill presented by the UP government was stopped in the Legislative Council after being passed in the Assembly. Even though the government has an absolute majority in the Legislative Council.

In fact, the Yogi government had brought the UP Nazul Property (Management and Use for Public Purpose) Bill, 2024 with the intention of making the Nazul land of UP available for development schemes. The Nazul Land Bill was approved by the cabinet meeting chaired by CM Yogi Adityanath on Wednesday. After this, the bill was introduced in the Assembly by Parliamentary Affairs Minister Suresh Khanna. While presenting the bill, the government said that this law is being brought to provide relief to the economically weaker sections. Along with this, it was also told that the provision of vacating land from the poor has not been brought in the bill.

This law is being brought to meet the continuous and immediate need of land due to development projects of public importance. Despite this, the way the law was suddenly stopped from being made by saying that the roof will be taken away from the head of the poor, undoubtedly does not give the right message to the BJP. If the bill had to be stopped, then it should have been stopped earlier by discussing among themselves. At least the opposition would not have got a chance to attack.

1-The struggle between power and organization is still going on in UP

After the Lok Sabha election results, in the BJP Working Committee meeting in Uttar Pradesh, Deputy CM Keshav Prasad Maurya had said that the organization is bigger than the government. This was considered as an attack on the Yogi government by Keshav Prasad Maurya. Later, on many occasions, Keshav Prasad Maurya said similar things. The Yogi government got the Nazul land bill passed in the Assembly, but in the Legislative Council, BJP state president Bhupendra Chaudhary opposed it and forced the bill to be sent to the Select Committee. If Chaudhary had any complaint about the bill or if the opposition suddenly increased, then it needed to be resolved by sitting together. If there was a need, the bill could have been stopped. Suddenly stopping the bill in the Legislative Council means that either the Chief Minister is not listening to the organization or the organization did not talk to the Chief Minister. Obviously, this means that the conflict is still going on in the party. If there was so much internal conflict in the party regarding a bill, then there was no need to present it in a hurry. There was no bill so important that it could not be waited for a few more months.

2-What does the organization want to show by stopping the bill

This is the first time after the BJP government came to power in UP, when a bill has been stalled in the Legislative Council by the state president of the party opposing the bill after being passed in the Legislative Assembly. In such a situation, the question will arise that if this bill was to be sent to a committee, then why was it brought to the Legislative Assembly? And if it was stopped in the Legislative Assembly itself, why was it not sent to a committee? Is it not that this was done to give the message that the organization is stronger than the government. Because the leader of the house in the Legislative Council is Keshav Prasad Maurya and Bhupendra Chaudhary is also in the Legislative Council. Since the Chairman of the Legislative Council Kunwar Manvendra Singh accepted Bhupendra Chaudhary’s request and sent the bill to the Select Committee, it is clear that this opportunity would not have been available in the Legislative Assembly. It is obvious that Bhupendra Chaudhary would not have become an obstacle in the way of such a bill in the Legislative Council. If Prayagraj MLAs Siddharth Narayan Singh and Harsh Vajpayee felt that this would cause a lot of damage, then the issue should have been raised earlier. At least the Uttar Pradesh government would not have been embarrassed. In this way, BJP suffered a direct loss. A direct message went to the general public that the relationship between the government and the organisation is really very bad.

3- There was a proper provision to ensure that the poor do not lose their roof over their head

The biggest argument being given to stop the bill is that it will rob lakhs of poor people of their homes. But Suresh Khanna, while presenting the bill, had said that the bill does not have a provision to vacate the land from the poor. The government had clarified that the lease of those who have deposited the lease money on time will be renewed for 30 years. It was also said that schools, colleges, hospitals and government institutions will remain as they are. The government had also assured that rules will be made in such a way that the poor are not harassed in any way. But the narrative was set in such a way that if the bill is passed, hundreds of schools and colleges will be demolished. One MLA even said that the High Court building is also built on Nazul land, so will the government demolish that too? Suresh Khanna had clarified that it takes a lot of time to arrange land for public welfare works. Now Nazul land will be used only for public works.

4- In the name of the poor, land mafias are enjoying the Nazul land

There are more than 28 thousand hectares of Nazul land in different cities of Uttar Pradesh. The maximum land is in Prayagraj. That is why the leaders of that place are protesting the most. Nazul land has generally been used for public purposes, such as construction of schools, hospitals, Gram Panchayat buildings etc. A lot of Nazul land has been leased to people. The lease holders have sold the land at many places and have also got it registered. Some people are living there by building houses and some are also doing their business. But land mafias have also occupied thousands of acres. Newspaper reports of many cities of Uttar Pradesh tell how land mafias have occupied it. Land mafias are having fun in the name of poor people.

The news published in Dainik Jagran on 2 April 2024 tells that more than 100 such Nazul plots have been identified in Basti district which are occupied by others. The tehsil administration found in its investigation that the case of occupation of ten plots in the Civil Lines area has come to light. Residential and commercial constructions have been done on these plots. This includes tent businessmen, marriage hall businessmen, LPG agency holders. Apart from this, people who have occupied Nazul land in other parts of the city are also being identified. According to the tehsil administration, more than a hundred occupiers have been identified. They will be issued notices in a series.

Dainik Jagran, Lucknow, dated 15 March 2020, reports that about 100 acres of LDA land in the capital is under illegal occupation. About 14 hectares of Nazul land is also under illegal occupation. LDA has completely forgotten this entire campaign for the last one and a half years. After the Yogi government came to power, action was taken on strict orders from the Chief Minister. By the end of 2018, LDA had identified some land mafias. Some illegal encroachments were also removed. Under the anti-land mafia campaign, only 14 land mafias were identified in the entire city. Except for one or two of these, LDA has not been able to remove the encroachments made by land mafias on government land.

Dainik Jagran news in Gorakhpur on 18 March 2020 tells that

To maintain the hold on the land, more than 100 Rohingya families have been brought and settled here. In the revenue records, 15 acres of land is recorded as Tal Sumer Sagar and 7 acres of land as Nazul land.

A news published in Bareilly Amar Ujala on 13 March 2020 tells that the Jubilee Park where Mahatma Gandhi had once worshipped here is missing. Without changing the land use of the land surrounded by the park boundaries, so many government buildings including Sanjay Community Hall, Allen Club, Fire Brigade and Mayor’s residence have been constructed on it. On the instructions of the then Commissioner, the file buried in the Collectorate of Jubilee Park built on Nazul land was taken out. In the government records, 3.743 hectares of land is registered in the name of Jubilee Park on Gata number 81, but on the spot there is Sanjay Community Hall, Allen Club, Fire Department office along with Mayor’s residence, shops on the other side of the road in front of the Municipal Corporation, shops in the back part of Sitapur Eye Hospital and other constructions. There is 0.923 hectares of land on Gata number 82. Although the old pond is still there near Sanjay Community Hall, but it is not clear how much area it has on the spot.

5- Why are the BJP leaders of Prayagraj more worried?

According to media reports, there is about 1300 hectares of Nazul land in Prayagraj, on which people have been living by building houses for generations. Perhaps this is the reason why the BJP MLAs and leaders of Prayagraj region are opposing the Nazul land bill of the Yogi government the most. Be it Siddharth Nath Singh, BJP MLA from Prayagraj’s western seat or Harsh Vardhan, MLA from the city’s northern seat, both strongly opposed the bill. Raja Bhaiya is believed to have influence in Prayagraj, perhaps this is the reason why he is very vocal about opposing this bill. This area is also considered to be the area of ​​Deputy CM Keshav Prasad Maurya himself. A large part of the areas near Khusro Bagh in Prayagraj, Civil Lines, Ashok Nagar, Rajapur, Lookarganj, Shivkuti and Georgetown is settled on Nazul land.
