The wife living separately with her daughter did not disclose her income, the court said- then she is not entitled to get alimony from the husband

MP News : The Indore Family Court rejected the claim of the wife who demanded maintenance from her husband. The court rejected the woman’s demand because she hid the information about her bank account and income.

In her petition, the woman had demanded alimony of Rs 50,000 per month for herself and her 3-year-old daughter from her travel agent husband. She said that they both had separated in 2021 after two years of their marriage.

On August 7, after hearing the arguments of the petitioner and her husband, Principal Judge NP Singh of the Family Court dismissed the alimony petition citing a Supreme Court judgment. However, the court order was made available on August 22.

The court said, since the woman is a commerce graduate, she has not given any account details related to her banking transactions in her affidavit. It seems that she is earning income by doing some work.

The judge said, “The petitioner woman is earning but she has not disclosed her income. Thus, it is not possible to determine the amount she and her husband will bear for the maintenance of the minor girl child.”

The court reasoned that the woman is not entitled to receive any amount from her husband even for the maintenance of her minor daughter, as she has not clearly disclosed her bank account details and income in the affidavit.

The woman’s husband’s lawyer JS Thakur said that the couple got married in 2019, but after the dispute, the couple has been living separately since 2021. In this case, the wife earns herself and documents related to this were also presented in the court.
