On Wednesday, the special court rejected the CBI’s closure report in the gangster Anandpal Singh encounter case and ordered an investigation and filing of a murder case against 7 policemen, including the then Churu SP, who were involved in the encounter. After the court’s order, the police as well as the investigating agency have come under the scanner and a discussion has also started on the story of the encounter.

The incident is of 24 June 2017. Police had claimed that Anandpal Singh was killed during an encounter in Malasar village of Churu. Later, Rajput community came on the streets and protested by keeping the dead body on the road for 18 days. After that, in December 2017, Rajasthan government handed over this case to CBI. Police said that after laying siege to the house where Anandpal was hiding, he was asked to surrender, but Anandpal started firing at the police and in retaliation, Anandpal was killed.

After investigation, the CBI had claimed that it was an encounter. After that, the investigating agency presented a closure report in the court in August 2019. Anandpal’s wife Raj Kanwar and brother Rupendra Pal Singh challenged this report in the court in May 2023 and described themselves as eyewitnesses. On Wednesday, Jodhpur’s ACJM CBI court gave its verdict on this petition and rejected the CBI’s closure report which justified the encounter.

– In the second postmortem, it was said that tattoo-like marks were formed at the places where Anandpal was shot. The court accepted that tattoo-like marks are formed at the places where bullets hit, from close to the body to a distance of 6 feet.
– Wife Raj Kanwar said that Anand Pal was made to surrender by the police by asking his brother Rupendra. After surrendering, he was beaten up, due to which he suffered 22 injuries on his body. After that Vidya Prakash, Suryaveer and Kailashan shot 12-13 bullets at him.
– The doctor has written in his report that the bullet was fired from a distance of 2 to 5 feet.
– The then Home Minister Gulabchand Kataria said that I do not know anything about this. I had gone to sleep. I came to know about it from people in the morning. After this, the CBI’s ACM court has ordered to register a case against the then SP of Churu Rahul Barhat, the then CEO Vidya Prakash, the then CI Suryaveer Singh, constable Sohan Singh, Dharamraj and Dharamveer under sections 147, 148, 302, 326, 325, 324 and section 149 of the Indian Penal Code.

Police had arrived on the information that Anandpal was hiding in his house

According to Bhanwar Singh, the lawyer of the petitioners, the case dates back to 2017. The police had arrested Rupendra Pal and Devendra Pal. During interrogation, they informed the police that Anandpal was hiding in a house in Malasar. When the police reached that house on June 24, Anandpal was present on the roof. The police then asked Rupendra to persuade Anandpal to surrender and assured him that they would not harm him.

Police reached the roof, made him surrender, and then shot him!

The lawyer said that it was Rupendra who took the police team including SP Barhat through the stairs to the roof. Anandpal was convinced and surrendered, but the police beat him up and shot him from close range. He argued in the court that cartridges were found on the roof. Whereas the police claimed that they had fired from the ground below. The police team had not gone to the roof. The CBI report also does not mention the presence of Vidya Prakash on the spot. Whereas the cartridge used from his pistol was found on the roof.

Know about Anandpal…

Anandpal Singh was a resident of Sanward village in Ladnun tehsil of Nagaur district. He was a notorious gangster of Rajasthan from 2006 to 2017. Dozens of murder cases were registered against Anandpal Singh. These included Gopal Phogat murder case of Sikar, Jeevan Godara murder case of Didwana, Kheraj murder case, Shruti loot murder and many other musical cases. Gang war and murder case was also included in Bikaner jail. On 3 September 2015, after appearing in Didwana court, Anandpal Singh was going to Ajmer High Security Jail in a police van. During this time, he escaped by dodging the police near Parbatsar. Anandpal remained a headache for the police even during his escape. Anandpal Singh had encounters with the police many times. A policeman Khumaram lost his life near Khinvsar. People were injured in encounters many times. Finally, on 24 June 2017, the police allegedly killed Anandpal Singh in an encounter at Shravan Singh’s house in Malasar village of Churu.

However, Anandpal Singh’s family and his supporters called it a murder and constantly demanded a CBI inquiry. Anandpal Singh’s last rites were not performed for 18 days after the incident and riots were seen in Anandpal Singh’s village many times. There was also a clash between the people and the police. Two people also lost their lives. Many policemen were also injured. Later on 13 July 2017, the police forcibly performed the last rites of Anandpal Singh. During this time, no member of Anandpal Singh’s family was present. Neither was any villager.

The police accused two dozen people of Rajput community of being involved in the riot, which included many big leaders. However, Anandpal Singh’s family did not lose courage and kept demanding a CBI inquiry into the encounter. When the CBI gave a clean chit to the policemen involved in the encounter in the closure report, Anandpal Singh’s wife challenged it in the court.
