Swati Maliwal assault: Bibhav Kumar gets another setback, petition against arrest rejected in High Court

Bibhav Kumar Case: The Delhi High Court on Friday dismissed a plea by Chief Minister Arvind Kejriwal’s close aide Bibhav Kumar challenging his arrest in connection with the alleged attack on Aam Aadmi Party MP Swati Maliwal at the chief minister’s residence. “The plea is dismissed. Bibhav Kumar is currently in judicial custody. He is alleged to have attacked Maliwal at Kejriwal’s official residence on May 13. He was arrested on May 18,” Justice Neena Bansal Krishna said.

Bibhav Kumar’s argument

Bibhav Kumar had requested in the petition to declare his arrest illegal and a gross violation of the provisions of Section 41A (notice to appear before police officer) of the Code of Criminal Procedure and against the law. Delhi Police opposed the petition and said that Bibhav Kumar was not arrested in haste, he was taken into custody as per law.

An FIR was registered against Bibhav Kumar on May 16 under various sections of the Indian Penal Code, including criminal intimidation, assault on a woman or use of criminal force with intent to disrobe her and attempt to commit culpable homicide not amounting to murder. Bibhav Kumar’s bail plea has been rejected by the trial court and the high court and is now pending in the Supreme Court.

The Supreme Court had also shown strictness

Earlier, in the case of assault on Swati Maliwal, the Supreme Court had also taken a tough stand on Chief Minister Arvind Kejriwal’s aide Bibhav Kumar. The court had asked sharp questions to Bibhav’s lawyer. During the hearing on Bibhav Kumar’s bail plea, the Supreme Court had said whether the Chief Minister’s residence is a private bungalow? Should such a ‘goon’ work in the Chief Minister’s residence?
