RSS defamation case, Congress MP Rahul Gandhi has got a big relief from the Bombay High Court. The Bombay High Court has quashed the order of the Bhiwandi court, which allowed some additional documents as evidence in a criminal defamation case filed against Rahul Gandhi by an RSS worker. Justice Prithviraj K Chavan has given this order on the petition filed by Rahul Gandhi. In this petition, it was alleged that the trial court had allowed RSS functionary Rajesh Kunte to present some documents late. The Bhiwandi Magistrate Court had taken on record some documents submitted by Rajesh Kunte on June 3. Rajesh Kunte is the complainant in the case against Rahul Gandhi. During this, the Magistrate Court had accepted the transcript of the alleged defamatory speech as evidence, on the basis of which the defamation case was filed. Rahul Gandhi had challenged it before the High Court on the ground that the magistrate’s order was in violation of the order of a single judge of the High Court in another petition filed by Rajesh Kunte, which was related to the same defamation complaint.

Rahul Gandhi had challenged the order of Bhiwandi court in the High Court

Rahul Gandhi challenged this in the High Court and the petition said that the order of the magistrate is in violation of the order of a single judge of the High Court in another petition filed by Rajesh Kunte. Let us tell you that in 2021, Judge Justice Revati Mohite Dere dismissed the petition filed by Rajesh Kunte, demanding that Rahul Gandhi either accept or deny the alleged derogatory speech. Justice Dere had argued that an accused person cannot be forced to accept or deny the annexures of the said petition. Rahul Gandhi has claimed in the present petition that despite the 2021 order of the High Court, the magistrate took the same documents on record.
