Omar’s argument in divorce case, ‘My marriage has been almost dead for 15 years’, SC issues notice to Payal Abdullah

Omar Abdullah, The Supreme Court has issued a notice to former Jammu and Kashmir Chief Minister Omar Abdullah’s wife Payal Abdullah on his plea in the divorce case. Omar has challenged the Delhi High Court’s decision in the Supreme Court in the divorce case. In fact, the Delhi High Court had rejected Omar’s plea seeking divorce from his estranged wife Payal Abdullah on the grounds of cruelty. Omar had challenged the 2016 decision of the High Court. The family court had rejected his plea related to divorce. The High Court said in its decision that it did not find any flaw in the order of the family court. It also agreed with the decision of the family court.

The family court had found that the allegations of cruelty against Payal Abdullah by Abdullah were vague. The bench said that Omar Abdullah failed to prove any act of physical and mental cruelty by Payal Abdullah. Omar Abdullah and Payal Abdullah were married on September 1, 1994 and due to mutual dispute, they have been living separately since the year 2009. They have two sons.

According to reports, Umar has demanded divorce from Payal in his petition. Senior advocate Kapil Sibal, who appeared on behalf of Umar in the Supreme Court, told the court that ‘this marriage has been almost dead for the last 15 years.’ After hearing Sibal’s arguments, a bench of Justice Sudhanshu Dhulia and Justice Ashanuddin Amanullah issued notice to Payal. Earlier, while hearing Umar’s petition for divorce, a bench of Justice Sanjeev Sachdeva and Justice Vikas Mahajan of the Delhi High Court said that the allegations of cruelty leveled by Umar against Payal are vague and not acceptable.

High court increased the alimony

Abdullah had filed an application in the family court on 30 August 2016 to separate from his wife. The court rejected the application citing lack of evidence. After the application was rejected in the family court, the National Conference leader approached the Delhi High Court. During the hearing of the case, the High Court in another order increased the monthly alimony to Payal. Justice Subramaniam Prasad ordered to pay Payal 1.5 lakh rupees per month and 60 thousand rupees each to their two children.
