New Criminal Law: First FIR registered in Delhi under new criminal law BNS cancelled

New criminal law First FIR: The first FIR registered against a street vendor in Delhi under the provisions of the Indian Penal Code (IPC) was quashed on Tuesday after the police filed a closure report in the court. Pankaj was booked on Monday for obstructing a public way in central Delhi’s Kamla Market area. The BNS and two other new criminal laws came into force from Monday.

A senior official said that the police started the process on Monday, but it was formally cancelled after filing a closure report in the Tis Hazari court on Tuesday. Pankaj was booked under section 285 of the BNS. He is accused of obstructing a public way to sell water bottles, bidis and cigarettes on a cart under a footover bridge near the New Delhi Railway Station. The FIR was registered at 1.57 am on Sunday-Monday night.

Mithun Kumar said that he is very happy that the FIR lodged against his brother has been cancelled. Mithun said, “We are relieved, but there is still uncertainty about whether we will be able to continue our work in this field or not.” He along with his brother sells goods on a handcart.

‘The police have quashed the case using the review provisions’

Home Minister Amit Shah said in a press conference on Monday that the Delhi Police has “canceled” the case registered against the street vendor after investigation. “Using the provisions of review, the police have cancelled the case,” he said.
