‘Loan recovery agents seem like gangs of goons’, harsh comment by Supreme Court

The loan taker is harassed by the bank agents if he does not pay the loan on time. Such cases are often reported in various media. In one such case, the Supreme Court has given a verdict in favour of the loan taker. Along with this, the Supreme Court has also directed to file a chargesheet against the loan recovery agency.

Supreme Court ordered to file charge sheet

The Supreme Court said that the institutions that recover the loans of banks seem to be a gang of goons. These institutions harass the loan holders with force. In such a case, if a complaint is received against the institutions, the police should take strict action. The Supreme Court, while hearing the petition of a loan taker in a case, ordered the police to file a chargesheet against the accused loan recovery institution. The bench of Justice Suryakant and Justice Ujjal Bhuiyan has also ordered the police to recover compensation from the loan recovery agent and give it to the victim petitioner.

Devashish had taken a loan to buy the bus

This entire case is of Debashish B Raichaudhuri of Kolkata. According to the information, he had taken a loan of Rs 15 lakh from Bank of India in 2014 to buy a bus. It was to be paid in 84 months through monthly installments of Rs 26502 from December 2014. The papers of the bus were mortgaged with the bank. Payments were made for a few months. Then when the payment was not made, the bank’s recovery agent first threatened and then misbehaved. After this, the bus was seized.

Dowashish B Raichaudhuri had filed a petition in the Supreme Court regarding this. While hearing the petition, the bench considered it unfair and fixed the amount of compensation and ordered its recovery from the recovery agent.
