Last day to decide on AAP office… Delhi High Court had given deadline to central government a week ago

The central government will clarify today where it is going to provide space for the national office of the Aam Aadmi Party. A week ago, the Delhi High Court had set a deadline for the central government and directed it to provide space. The High Court said that no more time can be given. A decision should be taken in this matter by July 25. However, what decision has the center taken? Has the place been marked for the AAP office or not? The situation is not clear on this yet.

In fact, the Supreme Court has directed AAP to vacate its current office located in Rouse Avenue. SC has given AAP time till August 10 as the last chance. Earlier in March, the Supreme Court had given AAP time till June 15 to vacate its Rouse Avenue office. This land was allotted to the Delhi High Court for expansion of judicial infrastructure.

The court had earlier given 6 weeks’ time to the Centre

AAP has requested the government to provide space to open its national office. This matter reached the High Court. On June 5, the court gave 6 weeks time to the Center to consider AAP’s request. HC said that AAP is entitled to get space for the party office in Delhi like other national political parties.

The High Court heard the case again on July 17. The Estate Directorate under the Union Ministry of Housing and Urban Affairs sought four more weeks to comply with the court’s order. The Directorate said that they are currently very busy with the work of allocating houses to MPs.

AAP has to vacate the current office by August 10

At the same time, AAP said that there is a deliberate delay in allotment of space so that we are left with no option. AAP said, the Supreme Court has given us time till August 10 to vacate our current office located at Rouse Avenue. AAP’s lawyer said, the Center did not even tell the Supreme Court that it is unable to follow the Delhi High Court’s order regarding allotment of space for the office. If you do not want to give the space, then who is stopping you from giving a logical order?

The High Court clearly said, considering the entire developments and circumstances, time is being given till July 25, 2024. The court hopes that no further application will be submitted by the applicant to extend the time.

What did the Delhi High Court say on June 5…

– Delhi High Court said that national political parties have the right to take a house from the general pool in Delhi by paying license fee till they get land to build their office. If AAP’s request is rejected by the Center, then the party is free to take legal action.
– AAP had filed two separate petitions in the High Court last year. On having the status of a national party, the party had demanded allocation of land or a residence on license basis in the national capital for the construction of its offices. AAP’s petition seeking land allocation is pending in the High Court.
– The party said that since all other national parties have been allotted land to build offices in central locations in New Delhi, a similar allotment should be made to AAP as per the Centre’s policy.

What did AAP say in the Supreme Court?

Earlier, AAP had told the Supreme Court that it was allotted this land in 2015. Now in 2023, the Land and Development Office is saying that this land has been earmarked for the Rouse Avenue Court expansion. AAP said that it is ready to vacate the premises, but it should be allotted an alternative place as per the status of a national party. The Aam Aadmi Party, which is in power in Delhi and Punjab, was given the status of a national party by the Election Commission last year.
