Krishna Janmabhoomi-Shahi Idgah dispute: HC will give important decision tomorrow on 15 petitions of Hindu and Muslim sides

The Allahabad High Court may give a big decision on Thursday in the Sri Krishna Janmabhoomi and Shahi Idgah case. The court will give its decision on this matter at 2 pm. Let us tell you that after the hearing in this case was completed on June 6, the High Court had reserved its decision. The court will give this decision on the petitions challenging the maintainability of the cases filed in connection with the Krishna Janmabhoomi-Shahi Idgah Mosque dispute in Mathura.

In fact, Justice Mayank Kumar Jain had reserved his decision on June 6 on the petition filed by the Muslim side regarding the maintainability of the cases. Several cases have been filed seeking the “removal” of the Shahi Idgah Mosque located near the Krishna Janmabhoomi temple, with the litigants claiming that the Aurangzeb-era mosque was built after the demolition of the temple. The mosque management committee has challenged these cases in its petition. Let us tell you that a decision will be taken on a total of 15 petitions related to Sri Krishna Janmabhoomi and Shahi Idgah.

The Muslim parties – the Masjid Management Committee and the UP Sunni Central Waqf Board – have argued that the suits are barred under the Places of Worship Act 1991. According to the Muslim side, the suits themselves admit the fact that the mosque in question was built in 1669-70.

Know what has happened so far
The petitions filed by the Hindu side claim that the mosque has been constructed on 13.37 acres of land of Katra Keshav Dev temple. Let us tell you that on 14 December 2023, the Allahabad High Court accepted the petition seeking the formation of an advocate commission for the survey under the supervision of the court of the Shahi Idgah Mosque complex adjacent to the Shri Krishna Janmabhoomi temple in Mathura. This order of the High Court was challenged by the Muslim side in the Supreme Court. After this, on January 17, the Supreme Court stayed the order of the Allahabad High Court to constitute an advocate commission on the petition of the Muslim side, but the Supreme Court had made it clear that the hearing before the Allahabad High Court in the dispute including the maintainability of the case under Order 7 Rule 11 of the CPC will continue.

After the Supreme Court’s stay order, the Hindu side had also filed a petition in the Allahabad High Court demanding a revenue survey. In May last year, the Allahabad High Court had transferred all the cases related to the Shri Krishna Janmabhoomi-Shahi Idgah Mosque dispute from the Mathura Court to itself. Let us tell you that the Muslim side is arguing that the petitions filed by the Hindu side are not maintainable.

The Muslim side has also presented arguments regarding the agreement made in 1968. Under this, 13.7 acres of land of Keshav Dev Katra has been given to Shahi Idgah Mosque. Along with this, the Muslim side has cited the Places of Worship Act, Limitation Act, Waqf Act and Special Relief Act of 1991. This case is barred by these four acts, so its hearing cannot take place here. A single bench of Justice Mayank Kumar Jain will give its verdict on this matter.
