Kolkata incident: CBI arrested Sandip Ghosh under these sections, he can be sentenced to life imprisonment!

In the Kolkata scandal, the CBI on Monday arrested the former principal of RG Kar Medical College and Hospital, Sandip Ghosh. The investigating agency arrested him in the corruption case in the institute after questioning him for about 15 days. Sandip Ghosh was called for questioning at the CBI office in Salt Lake, Kolkata. After this, he was taken to the CBI’s anti-corruption wing in Nizam Palace, where he was shown arrested.

Dr Akhtar Ali, former deputy superintendent of RG Kar Medical College and Hospital, had lodged a complaint of financial irregularities in several cases in the institute during Sandeep Ghosh’s tenure as principal. Allegations were made in it such as smuggling of unclaimed bodies in the hospital, corruption in disposal of bio-medical waste, nepotism in construction tenders, etc. It was earlier being investigated by the Kolkata Police, but the investigation was handed over to the CBI on the orders of the High Court.

On August 19, Kolkata Police registered a case against Sandip Ghosh under Sections 120B, 420 of IPC and Section 7 of Prevention of Corruption Act, 1988. After this, on August 24, following the order of Kolkata High Court, CBI took over the investigation. He has been arrested under the above sections. Maa Tara Traders, Madhya Jhorahat, Banipur, Howrah; Ishan Cafe, 4/1, Belgachia and Khama Louha are also accused in this case.

Know what punishment can be given under which section…

Section 120B of IPC- Section 120B of the Indian Penal Code is imposed for conspiring together to commit any crime. It is not necessary that the accused himself commits the crime. He can also be a part of such a conspiracy.

Punishment- Punishment for life imprisonment or rigorous imprisonment for a term of 2 years or more.

Section 420 of IPC- Cases have been registered under this section against those who cheat, defraud and acquire property dishonestly. But now under the Indian Penal Code (BNS) which came into force from July 1, Section 318 is being used instead of 420.

Punishment- Imprisonment for a term not exceeding seven years and fine.

Section 7 of the Prevention of Corruption Act, 1988- A case is registered under this section when a government officer or employee earns money other than his legal remuneration in connection with his official duties.

Punishment- Imprisonment for a term ranging from 6 months to 5 years and fine

CBI has interrogated Sandip Ghosh for 150 hours

The CBI has questioned Sandeep Ghosh, former principal of RG Kar Medical College and Hospital, for more than 150 hours. He has also been questioned in connection with the investigation into the rape and murder of a postgraduate trainee doctor on the morning of August 9. The CBI has also conducted polygraph tests on Sandeep twice to know all the truths related to this case. During the first test, Sandeep did not give satisfactory answers to the CBI’s questions.

CBI officials conducted searches at Sandeep Ghosh’s house and hospital. An official said that three teams have been formed to investigate the financial irregularities. The first team conducted an investigation by visiting the morgue of RG Kar Hospital. They inquired about the infrastructure there, the protocols involved in keeping the bodies safe and conducting post-mortems. The five-member team spoke to the doctors and staff of the hospital, which included Dr. Saptarshi Chatterjee.

The second CBI team went to the Chest Department on the third floor of the emergency building of RG Kar Hospital, where the victim was on duty that night, and inspected the crime scene. Nurses and other hospital staff were spoken to there. Earlier, only one arrest could be made in this case, which was of the main accused Sanjay Roy, who is currently in judicial custody. Now the second biggest arrest in this case is that of Sandeep Ghosh.

Akhtar Ali, former Deputy Superintendent of RG Kar Medical College, had said that during the tenure of Sandeep Ghosh, there were many financial irregularities in the functioning of the institution. He was also involved in many unethical activities and corruption. Students were deliberately failed, and then money was taken in the name of passing them. He had also complained about this to the Vigilance Committee. He also became a part of the investigation. But he was transferred before the final report.

Akhtar Ali had also claimed that Sanjay Roy, the prime accused in the brutality against the female doctor, was involved in the security of former principal Sandeep Ghosh. He used to work as his bouncer. In this way, the whole case has become more complicated due to the allegations of a direct link between Sanjay and Sandeep. Akhtar Ali had said, “After this brutality, when I saw the picture of the accused Sanjay Roy, I remembered that this person was one of the 4 bouncers of Sandeep Ghosh.”

He further said, “When I was working there, no one was allowed to go near the seminar room or the nursing staff at night. There was security at every point. CCTV cameras were installed, but a volunteer enters the room at night and such a big incident happens. This is beyond comprehension. This could be a big conspiracy.” After the revelation of this heinous murder, Sandeep has also been accused of negligence. He had tried to cover it up.
