Bail denied to the four co-owners

The magistrate court had refused to grant bail to basement co-owners Parvinder Singh, Tajinder Singh, Harvinder Singh and Sarabjit Singh, following which they approached another Delhi court. Additional Sessions Judge Rakesh Kumar, while hearing the appeal of the co-owners, granted them liberty to file a bail plea before the appropriate or CBI court. Amit Chadha, counsel for the basement co-owners, said, “After getting the (written) order from the court, we will file a fresh bail plea before the CBI court today.”

Delhi coaching centre death case investigation handed over to CBI

The court criticized the Delhi Police for arresting a driver in the case of death of three candidates due to waterlogging in the basement and said, it is a good thing that you did not issue a challan for rainwater entering the basement. The court said, you should have said how dare the water enter the basement. The way you arrested the SUV driver for driving the car there, you could have fined the water as well. The driver Manuj Kathuria was accused of driving his vehicle through a submerged road on July 27, due to which the water hit the gate of the three-storey building where the coaching center was located and the gate broke. It was alleged that due to this the basement of the building was filled with water, in which three students died due to drowning.

Instructions to CVC to monitor the investigation

A bench of Acting Chief Justice Manmohan and Justice Tushar Rao Gedela asked the Central Vigilance Commission (CVC) to appoint a senior officer to monitor the investigation by the CBI in the criminal case in a time-bound manner. The court said, “We need to look at the bigger picture as there is a much more fundamental problem in the city and it is time to relook at the administrative, financial and physical infrastructure of Delhi which has become outdated and does not correspond to the present needs.” It constituted a committee headed by the Chief Secretary of Delhi and also comprising Delhi Development Authority (DDA) Vice Chairman, Delhi Police Commissioner and Municipal Corporation of Delhi (MCD) Commissioner to deal with the issue and submit a report within eight weeks.

MCD reprimanded

The court said, keeping in mind the nature of the incident and to ensure that the public does not have any doubts regarding the investigation, this court hands over the investigation of the case to the CBI. The bench reprimanded the police and the Municipal Corporation of Delhi (MCD) over the drowning of the students and said that it is unable to understand how the students could not come out. The court also wanted to know whether the doors were blocked or the stairs were narrow. It said, what do you say? How did the children drown? You have just investigated. It is August 2 now. Why could they not come out of the basement? The basement does not fill with water immediately. It takes at least two-three minutes for the basement to fill with water, it cannot fill in one minute. Why could they not come out?

Officials are putting the responsibility on each other

The bench said that administratively, there are many authorities in Delhi who are only passing the buck to each other and are not doing anything else. It said that the general perception is that municipal officials are inefficient. The High Court told the Delhi government’s counsel that if the administrators are promoting the culture of freebies, then they do not know how to change the structure. One change in GST and the revenue will increase. You have to think out of the box. If you do not get revenue in a place like Delhi, you will not get it anywhere else, the court said. It said that the physical infrastructure in Delhi is about 75 years old and it is not only inadequate but is also not maintained properly.
