Asaram got parole, Ram Rahim got furlough… what is the difference between the two?

After Dera Sacha Sauda chief Gurmeet Ram Rahim Singh, Asaram has also got relief. Actually, Asaram, who is serving life sentence in a sexual assault case, has been allowed 7 days parole. Earlier, Ram Rahim got 21 days furlough and was released from jail on Tuesday morning. Now Asaram will be out of jail for 7 days and Gurmeet Ram Rahim for 21 days. Asaram got parole and Ram Rahim got furlough… in such a situation the question is what is the difference between these two and on what basis is it decided.

In how many ways does a prisoner get out of jail?

Whenever a prisoner is serving a sentence or is in jail in an under trial case, he is allowed to come out of jail for some time. This includes furlough, parole, bail etc., through which prisoners come out of jail.

What is furlough?

When a prisoner is serving his sentence and then he is given leave of a few days from jail, it is called furlough. Actually, after police investigation, when the court declares a person guilty and sentences him, then furlough is granted. On the other hand, undertrial prisoners are not given furlough. In furlough, a few days are given off from your sentence and after that the prisoner can stay out of jail. The special thing about furlough is that it is such a leave which is granted without any reason.

There is no need to give any reason for furlough and this arrangement has been made to stay away from the prison life for a few days. This is given to the prisoner from time to time without any reason so that the prisoner can maintain family and social relations for a few days. However, those prisoners who have a fear that it is not right for them to come out, they are not given furlough. The special thing is that the rules related to this are different for every state, like in Uttar Pradesh, prisoners do not have the option of furlough.

Many people believe that this is a legal right, but it is not so. This leave is given only on the basis of the opinion of the jail superintendent and it is seen whether the release of the prisoner will violate the public peace or not.

Then what is parole?

Now let’s talk about parole. Actually, parole is also a leave like furlough, in which the prisoner is allowed to come out of jail for some special reason. This is also available in the case of undertrial prisoners. In this, the prisoner has to give a special reason why he wants to go out. For example, prisoners are given this exemption in case of death of someone in the family or due to medical reasons, which is called parole. Parole is also of two types, one is custody parole and the other is regular parole.

In custodial parole, a prisoner is allowed to come out of jail under certain special circumstances, but he remains in police custody. For example, if the prisoner is allowed to meet someone, he can come out, but the police remains with him and after meeting him, the police takes him to jail. For example, Manish Sisodia was once given custody parole to meet his wife once a week. Apart from this, there is regular parole, in which the prisoner can roam freely anywhere. However, both parole and furlough have some conditions, with which the prisoner is released for a few days.
