In a dramatic turn of events, a New Mexico judge has dismissed the involuntary manslaughter charges against actor Alec Baldwin in the fatal shooting of cinematographer Halyna Hutchins on the set of the movie Rust. The judge ruled that the prosecution had improperly withheld evidence from the defense, leading to the case being dismissed with prejudice.
The term “dismissed with prejudice” means that the case is permanently closed and cannot be reopened or refiled by prosecutors. This decision effectively exonerates Baldwin, as he will no longer face legal consequences for the tragic incident that occurred in October 2021.
The dismissal came after Baldwin’s lawyers accused the prosecution of concealing evidence concerning ammunition given by a “good Samaritan” to a crime scene technician after armorer Hannah Gutierrez-Reed’s trial. The evidence in question was a set of live rounds of ammunition that, according to a witness, were filed in a different case file separate from the Rust file, with special prosecutor Kari Morrissey being directly involved in that decision.
Judge Mary Marlowe Sommer agreed with the defense, stating that the prosecution’s withholding of evidence was “wilful and deliberate” and that dismissal with prejudice was warranted to ensure the integrity of the judicial system. The judge emphasized that there was no way to right this wrong, leading to her final decision to permanently dismiss the case against Baldwin.

The trial had already begun when the dismissal occurred, with Baldwin breaking down in tears at the defense table and hugging his crying wife Hilaria Baldwin as other family members wept in the public gallery. The dismissal with prejudice means that Baldwin has nothing to answer for on these charges and they cannot be brought again.
