According to the rules of Rajya Sabha, to get the post of Leader of Opposition in the Upper House, a party should have ten percent of the total number of MPs in the House, which is currently 250 MPs in the Rajya Sabha.

According to the top leaders of Congress, the party cannot win a seat in Rajasthan due to less number of MLAs there but the party is expecting a seat due to victory in Telangana assembly elections. This discussion started when Keshav Rao resigned from BRS and joined Congress and also resigned from Rajya Sabha. There is a discussion that the party can send Keshav Rao to Rajya Sabha after which the number of Congress in the House will become 28.
