Kashi Vishwanath Temple-Gyanvapi Case: Allahabad High Court (Allahabad High CourtThe Supreme Court on Wednesday fixed July 9 for hearing a revision petition challenging the Varanasi district judge’s order refusing to allow the ASI to survey the wazookhana inside the Gyanvapi mosque in Varanasi.

No lawyer appeared on behalf of the Muslim side

The case is being heard by the court of Justice Rohit Ranjan Agarwal. When the hearing in this case began on Wednesday, no lawyer appeared on behalf of the Anjuman Intezamia Masjid Committee and no reply was filed on their behalf. In this revision petition filed by Rakhi Singh, one of the litigants in the Shringar Gauri Puja case filed in the Varanasi court, it has been requested that in the interest of justice it is necessary to conduct a survey of the Wuzu Khana area which will help the court in reaching a decision.

He had refused to give instructions for a survey of the washroom

Rakhi Singh’s lawyer Saurabh Tiwari has argued that it is necessary to get the Wazukhana surveyed by the Archaeological Survey of India (ASI) to determine the religious character of the entire property. The District Judge of Varanasi failed to exercise his jurisdiction vested in the law to order a survey of the Wazukhana. The District Judge had refused to order a survey of the Wazukhana in an order dated 21 October 2023.

ASI has already done the scientific survey

The review petition also argued that as per the Supreme Court’s direction, it is possible to survey the Wuzukhana area (except the Shivling) in a method that does not damage the structure. The ASI has already conducted a scientific survey of the Gyanvapi complex in Varanasi and has submitted its report to the District Judge of Varanasi. The ASI conducted this survey as per the order of the District Judge of Varanasi dated 21 July 2023.
