Union Minister of State for Social Justice and Empowerment Ramdas Athawale has strongly opposed any move to apply the creamy layer criteria in reservation for Scheduled Castes and Scheduled Tribes. This statement of Athawale, the head of the Republican Party of India (Athawale), comes in the backdrop of the Supreme Court’s decision in which it has approved reservation in the sub-categories of SC/ST.
Ramdas Athawale posted on X and wrote, ‘Republican Party strongly opposes the creamy economic criteria for reservation of Scheduled Castes and Tribes. Along with sub-classification in OBC and Open category, sub-classification should also be done in Scheduled Castes. The Supreme Court’s decision on sub-classification will provide justice to all Scheduled Castes.’

On Thursday itself, a seven-judge Constitution Bench headed by Chief Justice of India D Y Chandrachud ruled by a 6:1 majority that reservation can also be given by the states to sub-categories among the Scheduled Castes and Scheduled Tribes so that quota can be ensured for the more backward castes among them.
The Supreme Court has allowed the state governments to have quota within quota. However, in its decision, it has also made it clear that the states cannot take decisions based on their own will and political ambitions. If this happens, their decision can be judicially reviewed.
Suggestion given to Maharashtra government
Athawale said there are 1,200 Scheduled Castes in the country, of which 59 are in Maharashtra. He said that as per the Supreme Court’s decision, the Maharashtra government should form a commission to study the Scheduled Castes and sub-classify them into A, B, C, D categories. The Union Minister said that this will provide justice to all the castes falling in the SC category.
