‘NEET paper leak is limited to Patna-Hazaribagh only, it is not a systematic failure,’ Supreme Court’s decision

The Supreme Court has given its final verdict on the NEET paper leak case. The court said that after hearing the arguments of all the parties, we have come to the conclusion that this is not a systematic failure. The impact of the paper leak is limited to Hazaribagh and Patna. We have paid attention to the structural flaws. The court said that it is the responsibility of the government and NTA to ensure the identity of the candidates appearing for the exam, and to prepare an SOP for storage to prevent paper leak.

If someone’s complaint is not resolved by the Supreme Court’s decision, then he can go to the High Court. Our conclusion is that the paper leak is not systematic. The court further said that the paper leak has not happened on a large scale. NTA should take care for the future. Such negligence should be avoided. We are rejecting the demand for re-examination of NEET.

During the hearing, the court has asked NTA to change the way it conducts the exam. The court said that the agency should ensure strict scrutiny from the time of making the question paper to the end of the exam. An SOP should be made to check the handling of question papers, etc. Closed vehicles with real-time locks should be used instead of open e-rickshaws to transport the papers. Apart from this, privacy laws should also be kept in mind so that if there is any irregularity, it can be caught. Make arrangements for recording electronic fingerprints, cyber security so that the data can be secured.

EOU and CBI arrested several accused

CBI and EOU had investigated the NEET paper leak case. During this investigation, several accused were arrested and the report revealed that the paper was leaked from Hazaribagh and Patna in Jharkhand. CBI started sequencing on the report from EOU. CBI had registered the first FIR, in which eight accused were named. It includes the names of Sanjeev Mukhiya, Sikandar Yadavendu, Amit Anand, Ayush Raj, Nitish Kumar, Rocky, Akhilesh and Bittu. CBI first raided three places in Patna. The investigating agency reached Sikandar Yadavendu’s flat. After that, raids were also conducted at Learn and Play School and its boys hostel. NH Guest House was also searched. These are the places which are related to the accused of NEET paper leak case. Sanjeev Mukhiya had lodged students in Learn and Play School located in Khemnichak, Patna. It is alleged that 35 students were made to sit here and memorize the answers of the question paper.

After this, the CBI arrested the principal of Hazaribagh’s Oasis School and questioned him. According to India Today’s report, the accused named in the charge sheet include Nitish Kumar, Amit Anand, Sikandar Yadavendu, Ashutosh Kumar, Roshan Kumar, Manish Prakash, Akhilesh Kumar, Awadhesh Kumar, Anurag Yadav, Abhishek Kumar, Shivnandan Kumar and Ayush Raj.

Supreme Court’s decision regarding re-examination

On July 15, the Supreme Court ruled that the NEET UG 2024 exam will not be conducted again. Chief Justice DY Chandrachud said that after hearing both the sides, it is clear that the sanctity of the examination has ‘not’ been violated, so there is no need to conduct the examination again. The petition for re-examination on the basis of ‘paper leak and other irregularities’ was rejected.
